Privacy Policy

1. Introduction

Onyx & Oak Homes LLC ("Onyx & Oak," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect, how we use and share it, the tracking and analytics technologies we use, and the choices and rights you have, when you visit our website, submit a form, use our concierge tool, or opt into our text messaging program. By using our website or services, you agree to this Privacy Policy.

2. Information We Collect

  • Information you give us. Your name, email address, phone number, and anything you choose to tell us when you submit our contact form, request the Free Cost Guide, use our "Plan Your Home" concierge tool, or otherwise contact us. Depending on the form, this may include optional details about your project such as your land status, budget range, timeline, home size, and how you heard about us. These optional fields are never required.
  • Information collected automatically. When you visit the site, we and our analytics and advertising providers automatically collect technical and usage information such as your IP address, device and browser type, operating system, referring website, the pages you view, links and buttons you click, and the dates and times of your visits. Some of this is collected through cookies and similar technologies (see Section 3).
  • Session activity. We use a session-analytics tool (Microsoft Clarity) that may record how you interact with pages, including mouse movements, clicks, scrolling, and page navigation, to help us understand and improve the site. This tool is configured to mask the content you type into forms.
  • SMS data. If you opt into our text messaging program, we collect and store your phone number and the messages exchanged with us.

3. Cookies, Analytics, and Tracking Technologies

We use cookies, pixels, tags, and similar technologies to run the site, understand how it is used, and measure and improve our marketing. The specific providers we use are:

  • Google Analytics 4. We use Google Analytics, a service from Google LLC, to understand how visitors find and use our site. Google Analytics uses first-party cookies and identifiers to collect the usage information described above. We may also enable Google Analytics Advertising Features, which can include Google signals, remarketing, and demographics and interests reporting. When these features are on, Google Analytics first-party cookies (such as the Google Analytics cookie) and Google advertising cookies or other identifiers may be used together to help us understand our audience and reach past visitors with relevant ads.   • Meta Pixel and Conversions API. We use the Meta Pixel and related tools from Meta Platforms, Inc. (Facebook and Instagram) to measure the effectiveness of our advertising and to show relevant ads to people who have visited our site. To help match website activity to Meta accounts, we may use "advanced matching," which shares a hashed (irreversible, SHA-256) version of information you provide, such as your email address or phone number, with Meta.   • Microsoft Clarity. We use Microsoft Clarity from Microsoft Corporation for heatmaps and session replay to see how the site is performing and where it can be improved. Clarity's use of data is governed by the Microsoft Privacy Statement at privacy.microsoft.com/privacystatement.
  • Hosting and forms (Netlify). Our site and forms are hosted and processed by Netlify, which collects standard server and form-submission data (including IP address) to deliver the site and route your inquiry to us.
  • Email marketing (Klaviyo). When you submit a form, we send your contact details and submission to Klaviyo, our email platform, so we can deliver the Free Cost Guide, acknowledge your inquiry, and send occasional updates. You can unsubscribe from marketing email at any time using the link in any email.

Most browsers let you refuse or delete cookies through their settings. Some browsers offer a "Global Privacy Control" (GPC) or "Do Not Track" signal; where required by law, we honor GPC as a valid opt-out of sharing for targeted advertising. Blocking cookies may affect how parts of the site work.

4. How We Use Your Information

We use your information to respond to your inquiries and requests; provide the Free Cost Guide, concierge tool, and other services; communicate with you about your project (including by email and, if you opt in, SMS); operate, secure, maintain, and improve our website; measure and improve our marketing and advertising; and comply with our legal obligations.

5. How We Share Your Information

We do not sell your personal information for money. We share information only as follows:

  • Service providers who perform functions on our behalf, including the analytics, advertising, hosting, and email providers named in Section 3 (Google, Meta, Microsoft, Netlify, and Klaviyo).
  • For advertising measurement and audiences, as described in Section 3, which under some state laws may be considered a "sale" or "sharing" of personal information for targeted advertising. See Section 6 and Section 7 for your choices and rights.
  • Legal and safety reasons, when we believe disclosure is required by law or necessary to protect our rights, our clients, or the public.
  • Business transfers, in connection with a merger, acquisition, or sale of assets.

SMS is different. We do not share your mobile phone number or SMS opt-in data with third parties or affiliates for their marketing or promotional purposes. Text-messaging originator opt-in data and consent are not shared with any third parties.

Depending on where you live, you may have the right to request access to the personal information we hold about you; request that we correct or delete it; opt out of the "sale" or "sharing" of personal information and of targeted advertising; and not be discriminated against for exercising these rights. Residents of California (under the CCPA/CPRA) and certain other states have these rights. To exercise any of them, contact us using Section 12 below, and we will respond as required by law. You may also use an authorized agent where the law allows.

We keep personal information for as long as needed to fulfill the purposes described in this policy, to maintain our business records, and to meet legal requirements, after which we delete or de-identify it. Analytics providers retain data according to their own retention settings and policies.

9. Data Security

We use reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

10. Children's Privacy

Our website and services are intended for adults and are not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us information, please contact us and we will delete it.

11. Third-Party Links and International Users

Our site may link to third-party websites we do not control, and their privacy practices are their own. We operate in the United States, and your information is processed here. If you access the site from outside the United States, you understand your information will be transferred to and processed in the United States.

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the site after changes are posted means you accept the updated policy.

14. Mobile Messaging Program

Opt-In Process. By opting into our mobile messaging program via our contact form, you consent to receive recurring SMS messages from Onyx & Oak Homes. You agree to receive informational and promotional messages (build updates, offers, and similar) from Onyx & Oak Homes.

Message Frequency. You may receive up to 20 messages per month related to build updates, orders, and customer support.

STOP Instructions. To opt out of our SMS program, text STOP to (208) 497-5390. After sending STOP, you will receive a confirmation message, and no further messages will be sent unless you opt in again.

Terms and Conditions

1. Acceptance of Terms

By accessing and using the Onyx & Oak Homes website, services, or SMS messaging program, you agree to abide by these Terms and Conditions. If you do not agree, please discontinue use immediately.

2. Use of Services

You agree to use our services only for lawful purposes and in a way that does not infringe on the rights of others. Misuse of our website, SMS program, or any related services may result in termination of access.

By opting into our SMS program, you acknowledge that you are the owner or authorized user of the mobile number provided, you agree to receive informational and promotional messages (build updates, offers, and similar) from Onyx & Oak Homes, you consent to receive automated marketing messages, and you can opt out at any time by replying STOP.

4. Intellectual Property

All content on our website, including text, images, and branding, is owned by Onyx & Oak Homes and may not be copied, reproduced, or distributed without our permission.

5. Limitation of Liability

Onyx & Oak Homes is not responsible for any direct, indirect, or incidental damages resulting from the use of our services. We do not guarantee uninterrupted or error-free service.

6. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
